Internet Services: Cache Broadband Internet Agreement
Cache Broadband is responsible for my internet connection only. Cache Broadband is not responsible for maintenance, troubleshooting or repair or any wireless networking equipment, network interface cards, routers or local area networks.
VoIP Services: Cache Broadband Phone Terms of Service
Technical Limitations – Network congestion, weak wireless signals, radio interference, or any other causes of reduced internet access service performance may prevent you from using the VoIP service to call 911 or may delay the routing of your 911 calls or E911 information. You should not rely on the VoIP service as your primary method to obtain emergency services. If you do not feel comfortable with these limitations, we suggest you make alternative methods available to call 911 or otherwise obtain emergency services, such as through a traditional telephone line or a mobile phone.
Liability:
I acknowledge and agree that Cache Broadband will not be liable for any service outage(s), inability to dial 911, and/or inability to access emergency service personnel. You can view the Phone Service Agreement in its entirety at http://terms.cachebroadband.com
Payments & Charges:
I agree to pay and authorize Cache Broadband to charge my credit card(s) and/or checking account(s) provided, the service charge for my selected services, rental fees, additional items purchased during a service or installation call, fees and applicable taxes. I authorize the monthly charges to be withdrawn on the specified billing date(s). I agree to pay an additional $2.50 per month if I do not choose an auto-payment method.
I authorize a $25.00 charge for any returned checks or returned bank drafts and a $10.00 fee for any declined credit / debit cards per incident for any reason. If my payment is not received within seven (7) days of my billing date I understand a $5.00 late fee will be applied after twenty five (25) days, I will be charged a reconnection fee of $15.00 in the event of a disconnection of services. Cache Broadband reserves the right to refer your CBIA account to a third party for collection in the event of default. In the event any balance is not paid as agreed and is sent to collections, the front side undersigned agrees to pay a reasonable collection fee. In the event legal action becomes necessary to collect the unpaid balance, the I further agree to pay all reasonable attorneys fees and court costs.
Termination and Equipment:
I understand that I may cancel or change my service plan and options at any time by notifying Cache Broadband and receiving confirmation of such. Upon cancellation of service(s), I agree to grant Cache Broadband reasonable access to remove Cache Broadband owned equipment from my property, including items located inside the premises. If I do not allow access for removal of Cache Broadband equipment or return all equipment I agree I will be assessed a $500.00 charge until all such Cache Broadband equipment is returned in working condition.
Upon termination of your VoIP service(s), I agree and understand that if I cancel my VoIP services prior to the completion of the porting process by another provider my phone number may become the property of Cache Broadband and not returnable.
Acceptance:
The Customer agrees to all Terms of Service set out in this Agreement. Customer represents and warrants to Cache Broadband that Customer is of lawful age to enter into this Agreement and that (i) the Customer has the full right, power and authority to enter into this Agreement and to perform the acts required of Customer hereunder; (ii) the execution of this Agreement by Customer, and the performance by Customer of it obligations and duties hereunder, do not and will not violate any agreement to which Customer is a party or by which it is otherwise bound; and (iii)when accepted by such Customer, this Agreement will constitute the legal, valid and binding obligation of Customer, enforceable against Customer in accordance with its terms.
By using and accepting service(s) from Cache Broadband, Customer agrees to be legally bound by all of the Terms and Conditions of this Agreement and associated documents, the same as if Customer has signed this Agreement. These terms and conditions supersede all other written and oral communications or agreements with regard to the subject matter. Any waiver, modification or variations of these Terms and Conditions shall only be effective in writing and/or in the form of a business contract signed by and authorized officer of Cache Broadband.
By signing this form, I acknowledge and that: My Cache Broadband Internet and Phone services (if applicable), were installed to my satisfaction and that the services are working properly. I have read and I agree to the terms and conditions set forth in the Cache Broadband Customer Agreement, Rental Agreement, Acceptable use Policy and Privacy Policy.
